Important reform measures in order to minimize contact between officials and citizens and increase transparency in the appointment of disability were held (VIDEO)
In accordance with the Decree of the President of Azerbaijan Mr. Ilham Aliyev dated 14 September 2015, the appropriate changes were made in "Regulations on the criteria for determination of disability and health condition" in order to minimize contact between officials and citizens and increase transparency in the appointment of disability and the new Regulation was approved with the decision No. 413 of the Cabinet of Ministers of the Republic of Azerbaijan dated January 06, 2016. The minister of labour and social protection of population of the Republic of Azerbaijan Salim Muslumov gave information about it at a press conference held on January 6. The minister said that according to the Regulation, the period of disability of persons with disabilities with the second and third degrees of disability whose disability was defined until the day of the approval of the Regulation and period of disability was uncompleted until those date is extended for five (5) year term by Medical-Social Expertise and Rehabilitation Subsystem (TSERAS) established at the Ministry of Labour and Social Protection of Population. Disability of persons with disabilities of the first degree whose disability was defined until the day of the approval of the Regulation and period of disability was uncompleted until those date is determined by TSERAS for an unlimited period. The limitation of health of children under the age of 18 whose limitation of health was defined and the reasons referred to in subparagraph 3.1.1 - 3.1.22 of Regulation was uncompleted until the day of the approval of the Regulation is extended for three (3) years by TSERAS, not being over 18 years old: "In this regard, the Ministry of Labour and Social Protection of Population states appealing to persons with disabilities, persons with disabilities do not need to appeal to healthcare facilities, as well as Medical-Social Expert Commissions (MSEC) due to the expiration of the duration of the disability". S.Muslumov stated that, the persons who were appointed the first degree of disability and whose period of disability have completed will automatically be registered as a person of first group of disability for life through the TSERAS established at the Ministry of Labour and Social Protection of Population. Also it is put an end to the disability examination of persons of the second and third degrees of disability once a year with the previous rule and their disability examination will be carried out five years after the date of appointment of disability. The minister stated that this reform measure aimed at significant reduction of contact between officials and citizens creating conditions for negative cases in the field of disability examination, the establishment of a transparent environment for medical and social examination. Along with the aforesaid, significant changes have been also made in the process of appointment of initial disability in order to strengthen control over this area. So a decision on appointment of initial disability is carried out by mobile commissions established at the Ministry, consisting of medical and social expertise experts, not by the zonal MSECs until the application of new, automated management model. Commissions examine disability of citizens who applied for degree of initial disability, being in zone Medical-Social Expert Commissions (MSEC) at specific times and terms. Those who applied to zone MSECs for initial disability are informed in advance about the time when the examinations of disability to be conducted. Mobile commissions conduct examinations at that time and make a decision on whether the degree of disability was appointed or not on the spot, in accordance with the results of examinations. S.Muslumov brought to the attention that the results of all examinations carried out in connection with the examination of disability and limitation of health in the republic are included in TSERAS. Citizens to be conducted the disability examination also can obtain information on the results of this examination through "Provision of information on the examination conducted by the Medical-Social Expert Commissions" e-service presented by the ministry over the "E-government". So the user can present excerpt on the results of the examination conducted in the MSEC for determining his (her) disability to the organization required in the form of an electronic reference confirming his (her) disability or can send in electronic form, by getting in the form of pdf. The organizations where the reference is presented have the opportunity to verify the reliability of the reference over "E-government" portal through the relevant authentication code in this document.
