Sahil Babayev: "Serious reforms should be made in order to ensure transparency in the regulation of the labour market in accordance with the economic development process, to enhance the role of the State Labour Inspectorate Service in this area and to have effective working mechanisms derived from international innovation practices"
Minister of labour and social protection of population of the Republic of Azerbaijan Sahil Babayev held a meeting to discuss the activities of the State Labour Inspection Service under the Ministry, the issues of improvement of the system of state control over the observance of labour legislation and to define the upcoming tasks in this area.
S.Babayev underlined that as a result of the successful socio-economic development strategy of the President of the Republic of Azerbaijan, Mr. Ilham Aliyev, opening of new workplaces in our country has been permanently characterized, the employment level of the population has increased, and there is stability and pace of development in the labour market. The minister also emphasized the importance of controlling the implementation of legislation in the labour market, strengthening the principles of ensuring the rights of workers.
Noting that the activity of the State Labour Inspectorate Service in this direction is not at the required level, S.Babayev said that, first of all transparency in the system of labour inspectorate and in official-entrepreneurship relations should be fully ensured, situations that create conditions for corruption should be avoided, appropriate measures should be taken with respect to each of the citizens' applications in a short time, by conducting operative investigations, cases of procrastination in this area should not be allowed.
The minister noted the important social and economic importance of preventing non-formal employment. He said that the State Labour Inspectorate Service should make a worthwhile contribution to the country's socio-economic development achieving concrete results in the implementation of the "Action Plan on the Prevention of Non-formal Employment in the Republic of Azerbaijan" approved by the Decree of the head of state dated October 9, 2017, with purposeful measures in the field of legalization of non-formal labour relations. In this area, the integration of the Ministry's electronic information system into the relevant electronic government information systems is crucial.
S.Babayev emphasized that, according to the initiative of the President of the Republic of Azerbaijan, conducting inspections in entrepreneurship subjects have been suspended until 2021 by the adopted law and the requirements of this law should be strictly observed by the State Labour Inspectorate Service.
The Service should effectively carry out relevant investigations on the results of monitoring conducted by the Center for Monitoring of Labour Relations of "ASAN Service" in construction sites. At the same time, the introduction of the "ASAN Service" model in this field by the labor inspectorate system, simultaneously the implementation of the mechanism for controlling labour rights on the basis of advanced international experience through the electronic control system, the application of the "electronic protocol" project may be expedient.
The minister brought to the attention that operativeness in the investigation of industrial accidents should be increased and adequate measures should be taken, at the same time, relevant proposals should be made to the relevant authorities regarding preventive measures for prevention of such accidents, in general, conducting wide awareness of employers about preventive measures for occupational safety, analyzing the causes of accidents in the production process and avoiding such events. Additionally, administrative measures related to violation of labour law should not be completed, and active support should be provided to employers in the relevant field. The Service should establish its activities with other structural divisions of the ministry, in particular, in close cooperation with the State Employment Service, the State Social Protection Fund under the Ministry, as well as in the context of active cooperation with social partners - trade unions and employers' organizations and this action should contain practical results that may result in civilian satisfaction in the protection of workers' rights.
The minister emphasized that serious reforms should be made in order to ensure transparency in the regulation of the labour market in accordance with the economic development process, to enhance the role of the State Labour Inspectorate Service in this area and to have effective working mechanisms derived from international innovation practices. The minister gave instructions to prepare a package of proposals in this regard.
The current situation in the field of state control over the observance of labour legislation was discussed, the upcoming tasks were identified and respective assignments were given at the meeting.
