The annual rate of working time in a 40-hour work week for 2018 is 1919 hours
The Rate of working time and Production calendar of 2018 was approved by Resolution No. 18 of the Board of the Ministry of Labour and Social Protection of Population of the Republic of Azerbaijan dated December 20, 2017.
It was stated in the Rate of working time that according to the paragraph 2 of the Article 105 of the Labour Code Republic of Azerbaijan and the decision No. 540 of Cabinet of Ministers "On Novruz, Ramadan, Gurban holidays in 2018" dated December 6, 2017, January 1-2 (New Year holiday), January 20 (Day of National Mourning), March 8 (Women's Day), March 20, 21, 22, 23, 24 (Novruz holiday), May 9 (Victory Day over Fascism), May 28 (Republic Day), June 15 (National Salvation Day of Azerbaijan), June 15-16 (Ramadan holiday), June 26 (Armed Forces Day of the Republic of Azerbaijan), August 22, 23 (Gurban holiday), November 9 (Day of the State Flag of Azerbaijan Republic), 31 December (Day of Solidarity of World Azerbaijanis) are not considered working days in 2018.
According to the 5th and 6th units of Article 105 of the Labour Code and the decision No. 540 of Cabinet of Ministers "On Novruz, Ramadan, Gurban holidays in 2018", in connection with coinciding of holidays that are not considered working days and one day of Ramazan holiday with the National Salvation Day of the Azerbaijani people, January 3, March 26 and June 18-19 in the five-day working week, while January 3 and June 18 in the six-day work week are the days of rest. February 2018 consists of 28 calendar days, while the year of 365 calendar days.
According to Article 8.2 of the Election Code of the Republic of Azerbaijan, the voting day is not considered a working day in the territory where the election (referendum) was held.
According to the Labour Code of the Republic of Azerbaijan, if the voting day falls on a holiday that is not considered national mourning or working day (except for cases stipulated in Article 84.2 of the Constitution of the Republic of Azerbaijan), the voting shall be scheduled for another working day of the month in which the voting will be held. According to Article 178 of the Election Code, Wednesday of the third week of October of the last year of expiry of the term of office of the President of the Republic of Azerbaijan, established by the Constitution is considered as election day. The election day shall be announced by the decision of the Central Election Commission and the decision of the Central Election Commission on the announcement of the election day shall be published no later than 2 days. October 17, 2018 is considered as Election Day of the President of the Republic of Azerbaijan, which is not considered as a working day until the official announcement in order to calculate the rate of working time of 2018.
It was noted in the document that there are 241 working days in a five-day work week (7 of them are working days before holiday, 1 of Day of National Mourning, 1 pre-election day), 108 rest days which are not considered working days (3 of them are not considered working days coinciding with holidays, 1 of not considered working day of one day of Ramadan holiday coinciding with other holiday) 17 feast days (2 coinciding with the holidays) which are not considered working days, 1 election day and 1 a Day of National Mourning (241 + 108 + 17 + 1 + 1-3 = 365).
According to the 89th and 90th articles of the Labour Code, normal daily working hours can not exceed 8 hours in the Republic of Azerbaijan and as a rule, a five-day work week with two rest days is set. Weekly normal working hours in accordance with the normal daily working hours can not exceed 40 hours. The rate of working time for 2018 is determined from the account 8-hour work day on 40-hour five-day work week. In accordance with Part 1 of the Article 108 of the Labour Code, the duration of weekly working days shall be reduced by one hour on working days before holidays, voting, as well as the Day of National Mourning.
In accordance with legislation, the annual rate of working time is 1919 hours in a 40-hour work week for 2018 (232 x 8 + 9 x 7 = 1919 hours).
According to the Articles 90 and 108 of the Labour Code, when applying six-day work week, the duration of daily working hours can not be more than 7 hours and the duration of next working day which is the before holiday shall not be exceed 6 hours. It was also stated in the rate of working time of 2018 that except the cases stipulated in Articles 91, 92 and 93 of the Code, the duration of weekly working days shall be reduced by one hour on working days before feast days which are not considered working days in Article 105 of this Code, voting, as well as the Day of National Mourning. 1919 hours in five-day work week in 2018 for employees working 40-hour work week should be applied in the workplaces of six-day work week.
Note that the correct calculation and application of the rate of working time in enterprises, offices and organizations in accordance with the requirements of the Labour Code, should be carried out according to the rate of Working Time and Production calendar of 2018, regardless of ownership and organization-legal form next year.
